Acceptance and signing of the study contract

Thank you very much for registering at the Luis Vives Study Center. To formalize your registration, we need you to accept the conditions of the study contract that you will find below, and to sign it. Once you do so, the signed contract will arrive to the email address you indicate in the form.





    If you are not of legal age, enter below the information of the student's father, mother or legal guardian, who will be the one who signs and accepts the conditions of the contract on your behalf.


    GENERAL CONDITIONS OF THE CONTRACT SIGNED WITH THE LUIS VIVES STUDY CENTER

    1. The student will make the payment of each monthly payment in advance between the 1st and 5th of each month (or the next business day if the 5th is a holiday). In case of non-payment, access to classes will not be permitted after this period. Failure to attend the course, or its cancellation by the student, does not imply the refund of any amount belonging to the current month. The cost of the monthly payment does not depend on the number of school days. The teaching offered by Centro de Estudios Luis Vives (hereinafter, "the Center") is exempt from VAT according to Law 37/1992. The Center's courses have an end date defined, generally, by the free tests prepared by the students. Students are informed of this date through the Center's various media outlets. Student registration is automatically renewed every month (or in 4-week fractions, for certain courses), to guarantee the reservation of their place in the classrooms. Therefore, for registration cancellations, students must notify the cancellation via email at least 15 days in advance before the following month. Otherwise, the student will be obliged to pay the following monthly payment.

    2. The registration certificates whose issuance is requested from the Luis Vives Study Center will only be made on the monthly payments already paid. If a certificate about the course is requested in advance, a fraction of the course fee must be paid, previously agreed upon between the Center and the student. This fraction of the payment will constitute a deposit, and will remain in the custody of the Center until the student completes the course. The aforementioned deposit will be returned in full to the student, once this period has ended, as long as this contract has been fulfilled, and all of the monthly payments contained have been paid, within the period reflected in the study certificate.

    3. The certificates of attendance and achievement issued by the Center, necessary for the management of visa extension, NIE application and other procedures with the Spanish Public Administration, will only be issued in the event that the student attends at least 85%. of the contracted classes.

    4. Cancellation and return policy. In the event that a student wishes to cancel his/her registration in the course:

      1. If said cancellation occurs within a period equal to or greater than 15 calendar days before the start of the course, the Center reserves the right to convert your registration to the course online. The student acknowledges the power of the Center to provide the course in online mode, and that said mode is similar to the face-to-face course, including all the resources necessary for the acquisition of the contents. However, due to the differences between in-person and online training, the Center is committed to guaranteeing the adequate assimilation of the knowledge programmed for the student through online teaching, even if this entails an extension in the duration of the course. After evaluation and according to the criteria of the Center itself, in the event that the student cannot be offered an online course appropriate to their learning needs, the Center will return to the student the amount they have paid for the contract, retaining only 200 euros as payment. registration fee, to which all those expenses derived from the management would be added (banking fees, mailing costs, etc.).

      2. If said cancellation occurs within a period of less than 15 calendar days from the start of the course, or once the course has started, the Center will not refund any amount to the student.

    5. Cancellation and refund policy for students who have requested and received a transcript. If the student has requested a certificate of studies, in order to present it to the Spanish Consulate or Embassy in their country, or other official organizations, to obtain a visa or residence card, as well as other advantages that could be obtained through of this certification, you may benefit from the cancellation and return conditions reflected in article 4, only in the event that you present the official documentation of the Spanish Consulate or Embassy of your country (or corresponding official body), with date, signature and seal. , in which the denial of the visa (or corresponding service) is expressly indicated, or the student's renunciation of the application for said visa (or corresponding service) is accepted. The start date of the course will be considered to be the date defined in the issued study certificate. The maximum period to submit the required official documentation is 30 days from the date of notification of course cancellation.

    6. In the event that the visa resolution response from the Embassy or Consulate is delayed, the student must notify the school of said delay or impossibility of making an appointment at the consulate at least 15 days before the start of the course. Only in this case, the Center may modify the course completion dates in the certificate at no cost.
    7. Registration modifications (cancellation or modification of subjects, without cancellation of the course) that the student wishes to make must be requested at the Center's secretariat. During the first 15 days after the student joins the course, they will be free. After the expiration of this period, each registration modification will have a cost of 50,00 euros.

    8. Lack of attendance or punctuality, even if justified, does not imply any type of discount on the price of the course. Complete punctuality will be required at class entry times. Students who, for whatever reason, arrive at the Center after the class has started, will not be able to join it.

    9. The student and/or his/her legal representative undertake to support the Center and its teachers to improve the student's behavior and better school achievement.

    10. In accordance with the requirements of the non-regulated education and training agreement, the Center has contracted professional civil liability insurance for all its workers. In any case, the Center is not responsible for accidents or personal injuries that the student could potentially suffer or for lost, stolen or damaged personal items that have not been deposited in the Center's secretariat.

    11. The Center reserves the right to temporarily or even definitively prohibit access to its facilities to any student who fails to comply with these rules or alters the coexistence relations at the Center. In case of temporary or permanent expulsion, the Center will refund the student 100% of the proportional part of the amount paid that has not been used.

    12. The schedules established for each of the courses are designed to satisfy the needs of the students. The Center reserves the right to modify these schedules, without prejudice to the needs of the students. The Center guarantees that schedule changes will be reliably communicated with a minimum period of 48 hours. In any case, it is guaranteed that the entire syllabus will be explained before the end of the course.

    13. By law, smoking is absolutely prohibited inside the building.

    14. The information and registrations that the student must formalize to take official tests or exams will be made by the student himself. The Center Secretariat will inform, through its various dissemination channels, of the calls that are of interest to its students, this information service being a mere courtesy of the Center, so any unwanted errors or omissions that may occur They could not be the subject of a claim by the students.

    15. For foreign students with a valid foreign baccalaureate: the student authorizes the Center to transfer his or her personal data to the National University of Distance Education, for the group management of obtaining the credential and taking the University Access Test. The cost of this management is 50,00 euros per student per call.

    16. During classes, the use of mobile phones or any other mechanical or electronic element that disturbs the normal development of classes is expressly prohibited. In addition, recording, as well as the dissemination of video or audio of the sessions taught at the center, whether academic or merely indicative, is strictly prohibited.

    17. The building in which the Luis Vives Sol Study Center is located is not for its exclusive use, but is shared with other centers and offices. For this reason, students are asked to respect the common areas and not remain in them during free hours and breaks. The furniture and fixtures of the Center are designed for the exclusive exercise of training. Any improper use of them by the students, which results in damage or breakage, will be borne by the student themselves.

    18. The Center will offer its students the possibility of carrying out extracurricular activities (cultural visits, leisure activities, museums, etc.). The program and price of these activities will be communicated to the students well in advance of their development. These extracurricular activities are carried out in places and with contents that, due to the experience of the Center's professionals who organize them, are generally well valued by the students who carry them out, but the Center does not, in any case, guarantee that they will be carried out. satisfy the wishes of the students who participate in them. For this same reason, the Center is not responsible for accidents or personal injuries that the student could potentially suffer or for personal objects lost, stolen or damaged during the development of this type of activities. Thus, the student expressly waives any claim against the Center for any of the possible eventualities mentioned above. Likewise, the Center reserves the right to modify its offer of activities, without prior notice, depending on availability and other causes. In the event of a modification to the activity program, the Center undertakes to maintain an offer of activities with similar characteristics and cost.

    19. In those courses in which the acquisition of syllabi is mandatory, they will be paid at the time of formalizing registration. The price of the courses and materials will depend on the type of course, the time of year and the number of teaching hours contracted by the student. In these cases, the syllabi will be delivered as the classes are taught and their delivery is conditional on attendance. The frequency of delivery of the syllabus will be determined by each teacher, but, in any case, they will be delivered in full before the end of the course.

    20. The student authorizes the Center to insert his or her personal image on the center's website. This authorization may be revoked at any time, with the Center being obliged to remove your image from said website within a maximum period of 30 days from its reliable notification.

    21. The Center has designed, within its prevention, safety and health plan, action protocols for exceptional situations, such as pandemics, confinements and other conditions unrelated to the Center's activity. The student agrees to support and follow the Center's instructions in relation to these protocols. With them, the Center guarantees the continuity of the service offered, in person, blended or online. The application of these protocols does not alter the student's obligatory compliance with this contract.

    22. Prior to booking the course, the student must notify the Center of all special needs that he or she may have in relation to the normal use of the course, whether physical (handicaps, intolerances, etc.), psychological (attention deficit disorders or hyperactivity, etc.), or any other type.

    23. The Center will develop its training activity in accordance with the school calendar published by the Department of Education of the Community of Madrid (https://www.educa2.madrid.org/)

    24. For students who contract private classes: in the event that the student cannot attend any of the scheduled classes, they must reliably notify (an email or a call is sufficient) the center of the cancellation of the class, at least 24 hours in advance. advance. Otherwise, the class will be considered taught and will be charged.

    25. For students who jointly contract private classes: the non-attendance of any of the students to any of these classes will not imply any discount on the price.

    26. INFORMATION REGARDING THE DATA COLLECTED

    27. The data provided by the interested parties may be incorporated into one or more automated files that constitute the database of students of Centro de Estudios Luis Vives SL, in accordance with Organic Law 15/1999, of December 13, on Data Protection. of a Personal Character (LOPD)

    28. Both the paper file and the automated file(s) into which the data is incorporated will remain under the responsibility of the Secretariat of the Luis Vives SL Study Center.

    29. The information obtained will be used EXCLUSIVELY for the internal management of the Luis Vives SL Study Center and will not be provided in any case to third parties.

    30. Personal data will be treated with the degree of protection established by Royal Decree 1720/2007, of December 21, which approves the Regulations for the development of Organic Law 15/1999, which establishes the security measures. security of files containing personal data, and the necessary security measures will be adopted to guarantee the confidentiality and integrity of the information.

    31. Interested parties may exercise their rights of access, rectification, cancellation and opposition, in compliance with what is established by the LOPD, before the Secretariat of the Luis Vives SL Study Center (Madrid. C/Arenal 18, 1st right).
